A local club owner’s application for a variance was denied by Davie’s Board of Adjustment Monday.
The commissioners room of the county’s administration building was filled to capacity for the public hearing.
Matthew Mussen, owner of Matthew’s Entertainment, opened an adult establishment in January inside a former gas station at 7675 NC 801, just outside the Cooleemee city limits.
After it was verified the establishment was operating as a topless bar, the county filed a complaint. A temporary injunction was granted on Jan. 25, and on Feb. 12 Matthew’s agreed to a permanent injunction that it would no longer operate as a topless bar.
At Monday’s meeting, Andrew Meadwell of the county's planning department told the board that the Davie County Zoning Ordinance allows an adult establishment within the Highway Business (HB) and Industrial (I1-I4) zoning districts with certain conditions. Matthew's is located in the HB district.
The establishment may not be within 1000 feet of a residentially zoned or residentially used property ... subscribe to the Davie County Enterprise Record, P.O. Box 99, Mocksville, N.C. 27028.
